PRIVACY POLICY

1.​ General Provisions

This Privacy Policy sets out the obligations of the Administration of the PICTORIC website shop.pictoric.com.ua (hereinafter — the Administration) regarding the non-disclosure and protection of the confidentiality of personal data provided by the User at the Administration's request during registration or when placing an order on the Website shop.pictoric.com.ua.

This Privacy Policy applies to all information that PICTORIC may collect about the User while they use PICTORIC and its services. By registering or making purchases on PICTORIC, the User gives full consent to the collection and processing of their personal data in accordance with the Law of Ukraine "On Personal Data Protection" and the terms of this Privacy Policy.

This Privacy Policy may be changed by the Administration without prior notice. The current version of the Privacy Policy is always available on the PICTORIC website.

2.​ User's Personal Data

2.1. Basic Terms

During registration or when placing an order, the User provides the Administration with personal data, in particular their first name, last name, phone number, email address and the delivery address for goods/services.

While the User uses PICTORIC, the system may, automatically or with the User's participation, collect additional personal and technical information, in particular the IP address, browser version, country, language, UTM parameters, partner tags, the referrer address (previous page) and other technical data that may be used to identify the User without taking additional measures.

Authorization on PICTORIC takes place exclusively locally through the website's own system at shop.pictoric.com.ua.

2.2. Payment Policy

Payment for PICTORIC goods and services is made through the Hutko payment system (supporting Visa, Mastercard and ПРОСТІР cards, as well as Apple Pay and Google Pay wallets). This payment system collects and stores financial information in accordance with the Public Offer Agreement / License Agreement and the Privacy Policy.

The Administration does not store any of the Users' bank card data. PICTORIC is not a payment system, as it only receives authorized notifications about the User's payments.

At the same time, when a payment is received, the Administration may collect additional information, in particular the transaction number, transaction time, order details and other information necessary for the proper performance of its obligations to the User.

2.3. Personal Data Requested by Third-Party Services

The User's data may be provided in anonymized form to third parties, in particular web analytics services (for example, Google Analytics), solely for the Administration's internal analytics and to improve the performance of the Pictoricshop website.

2.4. Activity Tracking

While the User is logged in to their Account, the following actions are recorded for security purposes, fraud prevention and correct order fulfillment: date and time of login, date and time of order creation, date and time of order changes, purchase history, and the date and time of password and email changes.

3.​ Methods of Collecting Personal Data

The main ways of obtaining personal information from Users are:

a) The User provides personal information directly (for example, when registering on PICTORIC, filling in forms in the Personal Account or arranging delivery);

b) Personal data is collected automatically when the User browses or uses PICTORIC, in particular by means of cookies.

4.​ Use of Personal Data

The Administration may use the Personal Data provided to it by the User in order to:

a) Create an Account and a Personal Account for using PICTORIC;

b) Process orders, arrange the delivery of goods and provide technical support;

c) Send notifications by email or to a phone number (SMS/messengers), such as registration confirmations, order status and delivery information. These notifications are technically required for order fulfillment;

d) Send informational materials containing PICTORIC news, information about promotions and new arrivals of goods/services. To unsubscribe from these messages, the User must follow the unsubscribe instructions contained in each marketing message;

e) Provide personalized services (for example, setting the website interface language based on browser data);

f) Improve the performance of Pictoricshop based on anonymous aggregated website usage statistics.

5.​ Transfer of Personal Data to Third Parties

The Administration may share personal data with service providers that perform functions on its behalf. In particular, data is transferred to delivery services and logistics companies to transport purchased goods to the User/Buyer, as well as to newsletter services. These third parties are prohibited from using Users' personal data for their own purposes unrelated to fulfilling PICTORIC orders.

The Administration may disclose personal data if required by the current legislation of Ukraine or to protect rights and interests, where such disclosure is reasonably necessary to comply with the law or to prevent fraud. In particular, the Administration may disclose the User's data if it is lawfully requested by law enforcement or state authorities of Ukraine.

6.​ Data Storage

The User's personal data will be processed and stored on lawful grounds for the entire lifetime of the account. When the account is deleted, or at the User's request, the data is deleted, except where certain data must be retained in accordance with the requirements of tax and other applicable legislation of Ukraine (for example, information about financial transactions).

The Administration takes all necessary technical and organizational precautions to protect the User's personal data from unauthorized or accidental access, deletion, alteration, blocking, copying or disclosure by third parties.

In the event of loss or unauthorized disclosure of the User's personal data, the Administration shall immediately notify the User.

7.​ Cookie Policy

Cookies are small text files sent by the server to the user's device to save settings, enable automatic login and make the website easier to use.

Use of cookies:

a) Identification — cookies allow us to recognize your device and your Account, so that items are kept in your Cart and you are not asked for your login and password on every new PICTORIC page;

b) Analytics — cookies allow us to obtain information about the popularity of particular PICTORIC products and pages.

The User has the right to configure their browser to refuse cookies, but this will significantly limit the use of PICTORIC functionality (in particular, adding items to the Cart).

8.​ Managing Personal Data

The User has the right at any time to view, change or delete their Personal Data in the personal account (edit profile) or by sending a corresponding request to the website's official email address. The User may use the same channel to request the complete deletion of their account.

9.​ User's Obligations

The User undertakes to provide accurate and truthful personal data required for placing orders and delivering goods/services, and to keep it current and up to date.

10.​ Administration's Obligations

The Administration undertakes to:

a) Use the information provided solely for the purposes set out in Section 4 of this Privacy Policy;

b) Keep personal information confidential and not disclose it without the User's prior written permission, except in the cases specified in Section 5 of this Policy;

c) Take measures to protect the confidentiality of the User's personal information in accordance with standard security procedures;

d) Block or delete the User's personal data upon receiving a corresponding request from the User or their legal representative.

Personal data is transferred to state authorities solely on the grounds and in the manner established by the legislation of Ukraine.

11.​ Liability of the Parties

If the Administration fails to fulfill its obligations, it shall be liable for losses incurred by the User as a result of unauthorized use of their personal data, in accordance with the legislation of Ukraine, except where the personal data:

a) Was transferred to the authorities of Ukraine in accordance with the legislation of Ukraine;

b) Was disclosed by a third party after the Administration shared it with the User's consent;

c) Became public before it was lost or disclosed;

d) Was received from a third party before it was provided to the Administration;

e) Was disclosed with the User's consent or as a result of force majeure circumstances.
